Each figure’s source sits beside it, in its section below.

What these words mean3
Star ratings
CMS rates some kinds of place from 1 to 5 stars, more stars meaning better on CMS’s own measures for that kind: for a nursing home, its health inspections, staffing and quality measures. A rating is CMS’s summary of those measures; it doesn’t promise good care. Source: CMS, Care Compare and the Five-Star Quality Rating System.
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.

Jan 9, 2024: complaint inspection1 deficiency
  • Nurse Manager - 12 Mo Rn + 6 Mo Dialysis

    The inspectors’ words, 487 words

“PQ-NURSE MANAGER-12 MO RN+6 MO DIALYSIS CFR(s): 494.140(b)(1) (1) Nurse manager. The facility must have a nurse manager responsible for nursing services in the facility who must- (i) Be a full time employee of the facility; (ii) Be a registered nurse; and (iii) Have at least 12 months of experience in clinical nursing, and an additional 6 months of experience in providing nursing care to patients on maintenance dialysis. This Standard is not met as evidenced by: 37489 Based on document review and interview, it was determined that the facility failed to ensure the Clinical Manager held a current registered nurse license in the State of Arizona which has the potential risk of an unqualified staff member providing oversight for provision of patient care. Findings include: A copy of the “Quarterly Governing Body Meeting” minutes dated [04/28/2023] revealed that Employee #3 was governed in to be the “nurse in charge of nursing services.” Employee #1 confirmed on 01/08/2024 that while the current Charge Nurse was governed in to lead clinical services, that Employee #6 still served in the capacity role as Clinical Manager at the time of the survey on 01/08/2024. A personnel file was requested for the current Clinical Manager. A file was provided for Employee #6; however, the file only contained documentation from the Clinical Manager’s previous employment in another position at a facility in the State of Illinois. There was no Arizona RN license, Job Description, Education, Application, or current competencies. Employee #1 provided a copy of an offer letter extended to the current Clinical Manager. The letter revealed that Employee #6 was offered the position of Clinical Manager at Fresenius Medical Care North America located in Goodyear under the direction of Employee #1 with a start date of [07/01/2022]. Employee #1 also provided a copy of the Job Description for Clinical Manager. The Job Description titled “Clinical Manager” requires: “...Adheres to all requirements of the FMCNA Compliance Program, and FMS patient care and administrative policies. As the clinical leader, has the authority to make daily decisions to ensure continuity of care and patient and staff safety...EDUCATION: ...Graduate of an accredited School of Nursing (RN)...Current appropriate state licensure...Minimum of 12 months experience in clinical nursing is required...Minimum of 6 moths chronic or acute dialysis nursing experience is required....” A search of the Arizona State Board of Nursing website for Registered Nurse license verification revealed that Employee #6 does not have a current Arizona Registered Nurse license, nor does Employee #6 have a multi-state compact nursing license to practice in the State of Arizona. Employee #1 and 2 confirmed on 01/08/2024 that Employee #6 is currently employed as the Clinical Manager at the facility and does not have documentation that Employee #6 meets the educational requirements, nor does Employee #6 have the required appropriate state licensure for a Registered Nurse in the State of Arizona and as outlined in the job description for Clinical Manager.”
