What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

Staff #1 leaves the room to retrieve another cot. When the staff member returns, they grab Child #2 by the right arm and shoves Child #2 onto their sleeping cot.”

“EVIDENCE: In the staff lounge there was a working electric drill sitting on the table in the middle of the room. Rule 8VAC20-780-280-B.

Jan 25, 2024: inspection2 deficiencies
  • Based on a self-report, review of video footage, and review of documentation the facility failed to ensure that behavioral guidance is constructive in nature, age and stage appropriate, and redirects the children to appropriate behaviors.

    The inspectors’ words, 140 words

“Evidence: Video footage for 1/24/24 showed staff #1 engaged in inappropriate behavior guidance with child #1 who is preschool aged. At approximately 8:36am on 1/24/24 child #1 is seen taking a toy from another child. Staff #1 sees this and approaches child #1 and takes the toy and gives it back to the other child. Child #1 is then seen throwing a toy onto the table top because of this. Staff #1 then grabs child #1 by the upper arms and shakes the child aggressively several times while talking to him close to his face. The video has no sound, but staff statements stated that “staff #1 was heard telling the child we don’t do that here, do you want me to smash your tablet?” Staff #1then lets go of child #1 and the child goes to the ground crying.”

    Rule 8VAC20-780-400-B.

  • Based on a self report, review of video footage, and staff statements the facility failed to ensure that physical punishment, rough handling or shaking a child does not occur.

    The inspectors’ words, 103 words

“Evidence: Video footage for 1/24/24 shows staff #1 roughly handling and shaking child #1(preschool aged) approximately 3 times for behavior guidance. At approximately 8:36 am staff #1 is seen grabbing child #1 by the upper arms and shaking him approximately 3 times while talking to him closely in his face. Child #1 had taken a toy from another child, staff #1 saw this and walked over to child #1 and took the toy back and gave it to the other child. Child #1 then throws another toy because of this. Staff #1 then uses forbidden action, rough handling and shaking, as behavior guidance.”

    Rule 8VAC20-780-410-1.

Oct 26, 2023: inspection2 deficiencies
  • Based on review of video the center failed to ensure that behavior guidance is constructive in nature, age, and stage appropriate, and intended to redirect children to appropriate behavior.

“Evidence: Video showed that on 10/23/23 at approximately 10:39am, while playing outside on the playground, a staff member grabbed the hood of child #1 and pulls the child down backwards onto the ground from a standing position. Child #1 had just done the exact same thing to child #2 a moment before. The staff member used inappropriate non-constructive behavior guidance in this instance by physically engaging the child.”

    Rule 8VAC20-780-400-B.

  • Based on the review of video the center failed to ensure that a forbidden action was not used in behavior guidance.

“Evidence: Video shows that on 10/23/23 at approximately 10:39am, while outside on the playground, a staff member grabs the hood of child #1 and pulls him backward onto the mulch from a standing position. The child landed on his back. This is a forbidden action for punishment/behavior guidance as child #1 had just done the exact same thing to child #2 moments before.”

    Rule 8VAC20-780-410-1.

Apr 21, 2023: inspection2 deficiencies
  • Based on review of video the facility failed to ensure the care, protection, and guidance of the children as required.

“Evidence: On 4/14/23 at approximately 11:25am staff #1 failed to ensure the care, protection, and guidance of child #1 when she observed her standing on the lunch table. The staff did not speak to or go to the child to get her down, she watched her continue to stand on the table and then jump off directly towards another adjacent table where she landed feet first on the floor. This action posed a risk to the child, as the child could have hit her face on the adjacent table.”

    Rule 8VAC20-780-340-A.

  • Based on review of video the facility failed to ensure that rough handling of the children did not occur.

    The inspectors’ words, 111 words

“Evidence: Video showed on 4/14/23 that staff #1 rough handled child #1 on 4 occasions: 1. Video showed at 11:26am staff #1 grabbing child #1 forcefully by the arm to remove her from the sink area. 2. At 11:29am staff #1 pushed child #1 away from the door 2 times while trying to keep the child from exiting with the other children. 3. At 11:30amstaff #1 then grabbed child #1 by the arm as the child was on the floor near the door and placed her foot under the child’s bottom and lifted her up by the arm and her foothold and moved her to an area away from the door.”

    Rule 8VAC20-780-410-1.

What the record doesn’t say

  • Virginia doesn’t grade how serious a violation is, so no severity is shown.
  • Virginia publishes a complaint’s allegations and findings only when its inspection found a violation and the records are linked.
  • Virginia doesn’t publish staffing levels or owners for individual providers.
  • A plan of correction sent late, or not at all, isn’t online: Virginia says to ask the inspector.
  • Virginia’s pages show about the last five years of inspections; for older ones, Virginia says to contact the licensing inspector.
  • Virginia says this information may not be accurate, up to date or complete, and shouldn’t be the only source in choosing care.

None. Paid listings aren’t open yet. When they open, anything paid for will say “Paid by the provider”, and paying will never change a finding, a rating or the order of results.
