What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

DateWhatDetail
Oct 16, 2026OCCL Standards Complaint: SubstantiatedOn September 18, 2026, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of transporting children in an unauthorized vehicle not approved by OCCL, transporting children without proper safety restraints, and failure to have an organized system of business management due to no staff being available to receive children from the bus. An investigation was conducted on October 1, 2026. This complaint is substantiated. Interviews revealed that on or about September 14, 2026, the center was not prepared to receive Child #1 and Child #2 from the Brandywine School District (BSD) bus, resulting in the children being returned to their district preschool. Staff #1 then transported Child #1 and Child #2 to the center in their personal vehicle, which had not been approved by OCCL for the transporting of children. Staff #1 confirmed they had removed one of two car seats previously in the vehicle, and only one car seat was present in the vehicle for the two children when being transported by center staff. Administrator #1 and Staff #1 reported the center s handbook does not include a procedure for missed transportation, and neither was familiar with BSD s transportation protocol.
Apr 16, 2026OCCL Standards Complaint: No Evidence to Substantiate with ConcernOn March 9, 2026, the Office of Child Care Licensing (OCCL) received a complaint alleging use of confining equipment that is not developmentally appropriate for a preschool age child and staff using inappropriate behavior supports by yelling. An investigation was conducted on March 17, 2026. There is no evidence to substantiate this complaint for use of confining equipment not developmentally appropriate for a preschool age child in care or use of inappropriate behavior supports. While Person #1 stated Child #1 was observed in confining equipment, on multiple occasions, Administrator #1 denied seeing the use of a highchair to constrain a child and two classroom staff denied placing Child #1 in that confining equipment. There is no evidence to substantiate this complaint for staff yelling at children as Administrator #1 and two staff interviewed all denied use of yelling for behavior support. A concern noted at the visit was incident reports were not signed by a parent or guardian as required.
Mar 4, 2025OCCL Standards Complaint: No Evidence to SubstantiateOCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On January 28, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding concerns about not using proper sanitation procedures and failure to notify parents when children are exposed to contagious illness. There is no evidence to substantiate these allegations. All staff stated they use soap/water to clean and bleach/water and Lysol wipes to sanitize tables, toys, chairs, and classroom items. All staff stated floors are swept and mopped daily. Administrator #2 stated a janitor comes every morning and night to clean the classrooms before opening and after closing. LS #1 witnessed Staff #2, #3, and #5 wiping tables and/or mopping floors upon arrival to their classrooms. Families of children in the Preschool classroom were sent a ProCare notification on January 27, 2025, notifying them that a child in that class was diagnosed with Influenza and COVID-19 and to monitor their child for symptoms. On February 4, 2025, Staff #4 was diagnosed with the Flu and another notification was sent to the families of her classroom. Administrator #1 stated there were only two cases of Influenza and Covid on January 27, 2025, and one on February 4, 2025. LS #1 later contacted Administrator #2 and confirmed a soap and water solution was used to clean as well as the bleach and water solution to disinfect.
Jun 10, 2024OCCL Standards Complaint: No Evidence to SubstantiateThe Office of Child Care Licensing received a complaint on May 8, 2024, regarding not meeting the needs of all children, mixing preschool-age children with infants and toddlers, and the administrator not being present the required hours. There is no evidence to substantiate this complaint for not meeting the needs of all children based on interviews with the administrator and staff members. Administrator Linda Benson-Fleming stated Child #2 is currently working with Child Find and receiving services at the center. There is no evidence to substantiate this complaint for mixing preschool-age children with infants and toddlers because all staff members interviewed as well as the administrator denied placing a pre-kindergarten-age child in the infant or toddler classroom as a consequence for their behavior. There is no evidence to substantiate this complaint for the administrator not being present the required hours because Ms. Benson-Fleming stated she is present daily from 9:00 am to 5:00 pm and provided documentation of her attendance in the center the required amount of time.

What the record doesn’t say

  • Delaware doesn’t grade violations by severity, so read what was cited.
  • Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
  • Delaware publishes five years of reviews and complaints; this page shows the last three.
  • Delaware doesn’t publish staffing levels or owners for individual providers.
  • Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
