What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

Sep 18, 2026OCCL Standards Complaint: SubstantiatedThe Office of Child Care Licensing (OCCL) received a complaint on August 31, 2026, regarding concerns of failure to follow proper accident/injury procedures following a severe injury, and failure to notify OCCL regarding a serious injury resulting in the need for medical care. An investigation was conducted on September 10, 2026. This complaint is substantiated for failure to notify OCCL regarding a serious injury resulting in the need for medical care based on interviews conducted. Administrator #1 stated they did not notify OCCL within one business day that Child #1 sustained an injury requiring medical attention nor did they report the injury during the complaint visit conducted by OCCL staff on September 1, 2026. There is no evidence to substantiate this complaint regarding concerns of failure to follow proper accident/injury procedures following a severe injury based on interviews conducted. Administrator #1 and three staff members stated Staff #2 immediately attended to Child #1 and assessed Child #1 s injuries before transporting Child #1 for medical attention, as Staff #2 was the parent of Child #1.
Sep 17, 2026OCCL Standards Complaint: No Evidence to Substantiate with ConcernThe Office of Child Care Licensing (OCCL) received a complaint on August 31, 2026, regarding concerns of not calling emergency services for a child with a severe allergic reaction. An investigation was conducted on September 1, 2026. There is no evidence to substantiate this complaint regarding concerns of not calling emergency services for a child with a severe allergic reaction based on interviews conducted. Administrator #1 and Staff #1 stated Child #1 had hives and swelling around the eyes and was not determined to be in respiratory distress requiring staff to contact 911. Child #1 was newly enrolled in the program, and information provided by Parent #1 and Parent #2 during enrollment indicated an allergy but did not indicate the severity of the allergy nor was an Allergy Action Plan or Epi-Pen provided by the family. Additional concerns noted during the investigation were OCCL not being notified within one business day of Child #1 seeking medical attention, the facility not completing an incident report for Child #1, the facility not having an MAR to administer medication in case of an allergic reaction, and providing medication to Child #1 without written parent or guardian permission.
Aug 1, 2025OCCL Standards Complaint: No Evidence to Substantiate with ConcernThe Office of Child Care Licensing (OCCL) received a complaint on July 23, 2025, regarding concerns of not following illness exclusions and not providing proper notification to families of exposure to contagious conditions, not following sanitation requirements, and not following proper handwashing procedures. An investigation was conducted on July 28, 2025. There is no evidence to substantiate this complaint for not following illness exclusions and not providing proper notifications to families of exposure based on staff interviews. All staff interviewed stated they follow all illness exclusions and families were notified of Hand, Foot, and Mouth within the center via the KinderCare application. There is no evidence to substantiate this complaint for not following sanitation requirements based on staff interviews and observations of the toddler classrooms. All staff interviewed stated classrooms and toys are cleaned and sanitized daily, toys are sanitized daily and when mouthed, and classrooms and toys are continuously sanitized when an illness is present in the facility. No cleanliness or sanitation concerns were noted during the walkthrough of the facility, and proper cleaning solutions were observed in each classroom. There is no evidence to substantiate this complaint for not following proper handwashing procedures based on staff interviews. All staff interviewed stated staff members and children wash their hands at all required times throughout the day. A concern noted at the visit is Staff #2 is not fingerprinted and determined eligible for this KinderCare location. An additional concern noted at the visit is there was no staff member available during this visit who was trained in day-to-day operations while the administrator is not at the facility.
Jun 10, 2024OCCL Standards Complaint: No Evidence to SubstantiateThe Office of Child Care Licensing (OCCL) received a complaint on May 16, 2024, for concerns of incorrect staff-to-child ratios, not following enrollment procedures, not following child health exclusion policies, the cleanliness of the indoor space, and staff using their cell phones. An investigation was conducted on May 20, 2024. There is no evidence to substantiate this complaint for incorrect staff-to-child ratios based on observation of the facility, interviews, and attendance records reviewed. All staff interviewed stated classrooms are in ratio at all times and attendance records showed all classrooms are in ratio and do not exceed maximum group size. There is no evidence to substantiate this complaint for not following enrollment procedures based on interviews and documents reviewed. Staff stated the facility has tour paperwork separate from enrollment paperwork. There is no evidence to substantiate this complaint for not following child health exclusion policies based on staff interviews. All staff interviewed stated the facility follows health exclusions for all children. Staff #1 stated there was a child present on May 16, 2024, whose eye was red due to a recent surgery, and noted this could have been mistaken as pink eye to a family. There is no evidence to substantiate this complaint for lack of cleanliness in the indoor space based on observation of the facility All classrooms were organized and appeared clean. There is no evidence to substantiate this complaint for staff using cell phones because all staff interviewed stated staff do not use cell phones in the classrooms and have control of the children. This licensing specialist observed classrooms and no staff were on their cell phone.

What the record doesn’t say

  • Delaware doesn’t grade violations by severity, so read what was cited.
  • Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
  • Delaware publishes five years of reviews and complaints; this page shows the last three.
  • Delaware doesn’t publish staffing levels or owners for individual providers.
  • Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
