What these words mean4
Inspection (survey)
A visit by state inspectors, often unannounced, who check a place against the rules it must meet. For nursing homes and other places Medicare pays, CMS calls these visits surveys: a standard survey of a nursing home comes at least every 15 months, and a complaint survey whenever a complaint calls for one. Source: CMS; 42 CFR 488.308.
Deficiency, citation, violation
What inspectors write up when a place didn’t meet a rule: the rule, what they saw, and when. CMS calls it a deficiency; states may say citation or violation. It is the inspectors’ finding, not a court’s, and the place is usually asked for a plan to correct it. Source: CMS, statement of deficiencies (Form CMS-2567); each state’s licensing agency.
Licence status
Whether the state’s licence lets the place operate now, in the state’s own words: licensed, on probation (allowed to keep operating on conditions, after problems), provisional, pending or expired. Source: Each state’s licensing agency.
Capacity
The most people the licence or certification lets the place care for at once: residents, children, beds or apartments, as the state counts them. It isn’t how many are there now. Source: Each state’s licensing agency.

Jan 14, 2026OCCL Standards Complaint: No Evidence to SubstantiateOn December 29, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding an allegation of failing to understand the needs of children. An investigation was conducted on January 6, 2025. There is no evidence to substantiate this complaint. After interviewing staff members and administration the needs of the children are being met through daily routines. The lack of accessibility of a spoon on one particular day was the result of unclear communication between the child and staff.
Aug 29, 2025OCCL Standards Complaint: SubstantiatedOCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On May 15, 2025, an incident of staff failing to use appropriate behavior supports was self-reported to OCCL by the facility. On June 3, 2025, the Office of Child Care Licensing (OCCL) received two complaints regarding the same incident. An investigation was begun on May 15, 2025, and concluded on August 13, 2025, after clearance from other agencies was received. This complaint is substantiated for staff failing to use appropriate behavior supports. A self-report from Administrator #1 and a review of camera footage showed Child #1 was restrained and handled roughly by Staff #1. As a result, Staff #1 s employment was terminated by the facility.
Jul 8, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn June 23, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding an allegation of failing to notify parents or guardians when their child has been exposed to a contagious disease or condition. A second complaint was received on July 2, 2025, regarding the same concern as well as incorrect staff-to-child ratio, failing to follow sanitization regulations, and failing to provide a parent with contact information for the owner when requested. An investigation began on June 26, 2025, and ended on July 3, 2025. There is no evidence to substantiate this complaint. After interviewing staff members, administration, and collecting documents, it was documented the administration communicated this information to families via the Class Dojo application and posted a notice on the affected classroom door promptly after receiving confirmation of the diagnosis of a contagious condition. DELACARE regulations for child exclusion state the symptoms for exclusion must include, but not be limited to, the following: rash with fever or behavior change. As a case of HFMD had just been confirmed in the classroom, it was appropriate to request Child #1 be examined by their health provider to determine the cause of their rash before returning to care. Interviews with staff documented surfaces and classrooms were sanitized as required, and contact information for the owner was provided to a parent the same day as requested. A review of attendance records documented classrooms were in correct staff-to-child ratio.
Jul 2, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn June 13, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding failing to maintain indoor temperatures within required limits and failing to notify the Office of Child Care Licensing (OCCL) of closing due to lack of air conditioning, not being truthful when providing information to parents, and disrespectful communication by staff. An investigation was conducted on June 26, 2025. There is no evidence to substantiate this complaint for each allegation. After receiving a self-report notifying OCCL, interviewing staff members and administration, and collecting documents regarding communication to families it was shown families were given truthful information throughout the duration of the air conditioning repairs. There is no evidence to substantiate this complaint for failing to maintain classroom temperatures within the required limits. The administrators were able to make a business and health and safety decision to close classrooms before the temperatures reached the DELACARE regulation required limit. After interviews with staff members and administration, there is no evidence to substantiate this complaint for disrespectful communication. All staff interviewed stated the administration communicated information to the families in a respectful manner.
Jun 23, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn May 19, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of a lack of respectful communication between staff members. An investigation began on May 30, 2025, and concluded on June 18, 2025. There is no evidence to substantiate this complaint for a lack of respectful communication between staff members. After completing interviews, staff members and administration all stated they have observed only respectful and professional communication between staff and administrators.
Jun 23, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn May 19, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding incorrect staff-to-child ratio, unqualified staff, lack of supervision, failing to have and follow a developmentally appropriate lesson plan, and toilet facility cleanliness concerns. On May 30, 2025, an investigation was conducted. There is no evidence to substantiate this complaint for these allegations. After interviews with administration, staff members, classroom observations, and reviewing documentation, the classrooms are in the correct staff-to-child ratio with qualified staff who create the appropriate supervision while following appropriate lesson plans that are available to parents and having clean toileting facilities.
May 19, 2025OCCL Standards Complaint: No Evidence to SubstantiateOn May 5, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding allegations of incorrect staff-to-child ratio and unqualified staff alone with children. An investigation was conducted on May 15, 2025. There is no evidence to substantiate this complaint for incorrect staff-to-child ratio. After reviewing attendance records and interviewing staff, all classrooms were found to be in correct staff-to-child ratio. There is no evidence to substantiate this complaint for unqualified staff members left alone as attendance records and staff interviews show the two unqualified staff members are not alone with children.

What the record doesn’t say

  • Delaware doesn’t grade violations by severity, so read what was cited.
  • Delaware’s open data lists a visit only when a violation was cited there, so visits that found nothing aren’t shown.
  • Delaware publishes five years of reviews and complaints; this page shows the last three.
  • Delaware doesn’t publish staffing levels or owners for individual providers.
  • Delaware lists only the visits that found violations, so a provider with none listed may not have been visited at all: no count of violations is used to headline, filter or compare its providers.
